Fines for Failing to Comply

From the 1st of July in 2021, when a brand new, renewed or varied tenancy is signed for an Ebdentown rental property, all Healthy Homes compliance tasks need to be completed inside of 90 days.

Since the 1st July of 2021, when a new or renewed contract is signed on the Ebdentown rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet one of the Healthy Homes Standards inside of the anticipated timeframe could result in a fine of up to $7200. In addition, if the currently-in place Healthy Homes Statement of Compliance isn’t included within the new, renewed or amended tenancy agreement there may be an additional fine or violation fee.

Anyone can request information about the Healthy Homes Standard and how they relate to the building they live in. If the landlord or property manager fails to provide the necessary information within 21 days of getting the notice, the tenant will be issued an infringement notice and be fined as high as $750.

Additionally, there is an additional fine of up to $900 for landlords or property managers providing a false or inaccurate Healthy Homes Statement of Compliance or information. The person responsible for this fine is whoever is listed on the tenancy agreement as the one who is letting the property out and it could be the name of the landlord or the company that manages the property.

All information in the Statement of Compliance needs to be correct when the tenancy agreement is completed, and is updated throughout the duration of the tenancy when any relevant work gets completed.

It’s important to remember that a landlord with several rental properties can face greater penalties for non-compliance. The harshest penalties are handed down for serious breaches. Landlords with at least six rental properties could be fined as high as $50,000, and as much as $100,000 for hearing claims.

When do I require to be in compliance with my Healthy Homes Standards?

Ebdentown Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to 30 June 2021

  • The insulation of the ceiling and underfloor is required throughout Ebdentown and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included in any renewal, new or varied tenancy agreement.
  • Landlords and property managers must keep records of their compliance with all Healthy Homes Standards that apply or will be applied throughout the tenancy period of an apartment rental.

Starting 1 July 2021

  • Property managers and private landlords must make sure that their rental properties are in compliance to the Healthy Homes Standards within 90 days of a new, renewed or varied tenancy.
  • All boarding households (except Kainga Ora and registered Community Housing Provider boarding home tenancies) are required to comply with Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All households rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of when the tenancy began.

Beginning 1 July 2024

  • All rentals homes must comply with the Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draughts increase the likelihood of lower temperatures in houses. A draughty house is more expensive to heat, which means wasting energy and increased bills.

For example, if an open fireplace isn’t in use it can cause draughts and must be sealed from. Property managers and landlords are accountable for making sure that draughts from the fireplace are removed whenever possible.

You don’t need to block holes or gaps which are part of the building. For example, tiny gaps around doors and windows could be necessary to allow for movement of the building when the house gets warmer and cooler, to allow them to be opened and closed rather than securing. Proper heating is crucial to ensure healthy homes

Heating Ebdentown

Rental properties in Ebdentown must have a fixed source of heating which can warm the living room to at least 18degC, even on the coldest winter days. This is the recommended minimum indoor temperature that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The source of heating requirements to be fixed (i.e. not portable) with at least 1.5 horsepower in capacity, and meet the minimum heating capacity needed in the living area. A Heating Assessment Tool could be used to determine whether the fix heater(s) are sufficient or if you’ll need to "top up" with a new heater. Open fires and unflued combustion heaters like portable LPG bottle heaters aren’t considered to be suitable heating options in the Healthy Homes Standard.

If the heating you provide is an electric heater or heat pump then it must have a thermostat. This makes the heating more reliable and efficient. For the majority of houses, bigger heaters that are fixed, such as heat pumps, wood burners, pellet burners or flued gas heaters will be required. In some instances, like small apartment buildings, a smaller fixed electric heater might be enough.

If the main living room already has a fixed heating source, such as a heat pump, then it might require a top up to ensure it meets the requirements. Certain types of heaters cannot be utilised to meet the quality since they’re either costly, not cost-effective to run, or unsafe to operate.

Ventilation Ebdentown

Insulation Ebdentown

Ceiling and underfloor insulation is a requirement for all rent houses since July 1, 2019. All landlords and property managers should ensure that the insulation meets the new quality.
