Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed contract is signed on a Kilbirnie rental property, all Healthy Homes compliance tasks have to be finished within 90 days.

Beginning on July 1st, 2021, when a brand new, renewed or varied lease is entered into on the Kilbirnie rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Failure to adhere to each of Healthy Homes Standards inside of the period of time expected can lead to a fine of up to $7200. Furthermore, if a existing Healthy Homes Statement of Compliance isn’t included in the renewal, new or revised tenancy contract, it could result in an additional penalty or infringement fee.

Any tenant can ask for details regarding the Healthy Homes Standard and how they relate to the home they live in. If the property manager is unable to supply the necessary information within 21 days from being informed of the request, they will receive an infringement notification and could be fined up to $750.

Additionally, there is an additional fine of approximately $900 for landlords and property managers providing a false or inaccurate Healthy Homes Compliance Statement or information. The person who is liable to pay this fine is the one who is listed on the tenancy agreement as the one who is leasing the property out which could be the landlord’s name or the company that manages the property.

All information in the Compliance Statement needs to be accurate when the tenancy contract is completed, and should be maintained throughout the duration of the tenancy when any necessary work related to it’s finished.

It is crucial to remember that a landlord with several rental properties can face additional fines for non-compliance. The highest penalties are handed down for serious violations, and landlords who own six or more properties can receive fines of up to $50,000 and as high as $100,000 in the case of hearing claims.

In the end, a failure to meet compliance with Healthy Homes requirements can hit your bank account with huge fines, in addition to still being required to adhere to the regulations. Healthy homes matter

What is the reason Healthy Homes Compliance So Important?

Around 1 in 3 households rent the property in New Zealand and Kilbirnie, and research has shown that these rental homes tend to be colder, older and are not as efficient heating and tend to be lower quality than homes that are owned by the owner.

Cold, damp and mouldy homes are linked to negative health outcomes, particularly ailments like colds and influenza, asthma, and cardiovascular issues. In addition, people who report four or more key home quality issues often suffer from low life satisfaction and reduced mental wellbeing.

Improving the standard of Kilbirnie rental property can help tenants enjoy better physical and mental health as well as lessen disruptions to their work, education and daily life due to health issues. Your investment will also be better protected from mould, mildew and damp damages, which means lower maintenance costs in the long run.

The Healthy Homes Standards are a list of the specific and minimum standards for Heating, Insulation Ventilation, Moisture ingress and Drainage, as well as Draught-stopping within Kilbirnie rental properties.

Unreasonable Gaps & Holes

Draught Stopping Kilbirnie

Draughts may lead to dropping temperatures within houses. A damp house is more expensive to heat, which completed jobs in wasting energy and increased bills.

If a draught could be perceived as a result of gaps or holes the area requirements to be closed.

What are unjustifiable gaps or holes?

If you can feel external air getting in, or see a clear draught out of a hole or gap, then it is likely to be a gap or hole that requirements sealing in any way. Cracks and gaps that are large should be permanently stopped. The gaps that exceed 3mm that allow air to enter or exit of your home require to be sealed. For example, if an open fireplace isn’t in use it can cause draughts and should be shut from. Property managers and landlords are responsible for making sure that such draughts are squelched whenever imaginable.

There is no need to block up intentional gaps or holes that are part of the construction. For example, tiny gaps around windows and doors may be required to allow for movement within the building as the house is heated and cools to allow them to be opened and closed rather instead of being stuck. We will inspect the windows and doors as part of the Healthy Homes assessment of your rental property.

Heating Kilbirnie

Kilbirnie rental properties need to have a stable source of heating that can warm the principal or the biggest living area to at minimum 18degC even on the coldest days of the year. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical health and mental outlook.

The source of heat needs for it to be permanent (i.e. not portable) with at least 1.5 Kilowatts in heating capacity, and meet the minimum requirement for heat capacity for the main living space. A Heating Assessment Tool could be used to determine whether the current permanent heater(s) are sufficient or whether you will need to ‘top up’ with an additional heater. Fires that are open and unflued heaters, such as portable LPG bottle heaters are not considered to be safe heating options under those following the Healthy Homes Standard.

If the heating system you provide is electric heating (or heat pump), then it must be equipped with the thermostat. This will help make the heating more uniform and effective. In most houses, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters are required. In certain situations, like small apartment buildings, a smaller fixed electric heater might be enough.

If the living area already has a permanent heating source, like heat pumps, it might just require an update to meet the standards. Certain kinds of heaters aren’t able to be used to meet the standard because they’re inefficient, unaffordable to operate or unsafe to operate.

Ventilation Kilbirnie

Each liveable space in a rental property has to have at least one openable windows or an exterior door to provide natural ventilation. In addition, high moisture areas like kitchens and bathrooms should have an externally vented extractor fan that can take moisture away.

A ventilation standard is all about understanding the fact that dry air is easier to heat and heat, and a well ventilated rental property is less likely to grow mould and damp.

Bedrooms, living spaces, dining rooms, and kitchens are considered to be liveable spaces. Spaces that connect, such as the hallway aren’t liveable , and thus do not need an opening window or door.

Every window, door or the skylight needs for them to be in a position to open to the outside, but remain at an open angle, allowing the circulation of fresh air and air flow.

The bathrooms in all kitchens and every other room of your home with a bath, shower cooker or any other moisture generating item will require suitable extractor fans that can be vented to the outdoors. Our Healthy Homes Assessment service will ensure that there is sufficient air circulation in every living space and will also check for the proper extractor fans for areas that are high in moisture.

Insulation Kilbirnie

The insulation of the ceiling and underfloor is required for all rent homes since July 1, 2019. Property managers and landlords have to make sure the insulation meets this new standard. In some instances, existing ceiling insulation or insulation in the sub floor space might need to be replaced or replaced.

A properly insulated home can help control condensation and lessen the likelihood of dampness and mould, and will also make more easy to allow the household to hold heat.

Insulation needs to be in compliance with the R-values of your area.

The "R" signifies thermal resistance, and it is a measurement of how well the insulation can withstand heat flow. The more R-value is higher, the more effective the insulation.

  • Zone 1 - Auckland & Northland - ceiling R 2.9 Underfloor R 1.3
  • Zone 2 – the rest area of North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3

Kilbirnie Moisture Ingress & Drainage

Keeping your rental property safe from dampness isn’t just about what’s inside the building It’s about having to make sure there is somewhere to allow surface, rain or ground water and also stop it from getting into the building. When it comes to moisture and damp it is typically not apparent that it can become a big problem, causing damages to your investment and harming your tenant’s health.

Properties that are rented must be equipped with effective drainage to get rid of rainwater, storm water, and ground water. This includes the proper outfall or runoff. Making sure that the water has a location to go and that it isn’t allowed to remain beneath buildings is an essential part of maintaining your property’s dry.

In addition to a drainage system to prevent moisture from entering, if your rental is enclosed between your floor and the soil, a ground-water barrier must be put in place when it is reasonably practicable to install it.

A ground moisture barrier is usually a polythene sheet laid over the ground to stop any moisture that is present in the ground from entering the property. It also helps to prevent any damage to your underfloor insulation.
