Fines for Failing to Comply

From the 1st of July in 2021, once a new or renewed tenancy is signed on a Lyall Bay rental property, all Healthy Homes compliance items have to be finished inside of 90 days.

From the 1st of July in 2021, when a brand new or renewed lease is entered into on the Lyall Bay rental property, all Healthy Homes compliance work must be completed inside of 90 days.

All information in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is signed, and ideally it is updated through the tenancy period as associated work has been completed.

It is important to keep in mind that a landlord who have multiple rental properties could face even higher fines for non-compliance. The highest penalties are reserved for serious violations. Those who have at least six rental properties could be fined as high as $50,000, and even as high as $100,000 in the case of hearing claims.

Lyall Bay Healthy Homes Compliance Timeframes

Tenancies commenced in the period between July 1st 2019 and 30 June 2021

  • The insulation of the ceiling and underfloor is required for all Lyall Bay and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent, an Insulation Statement and an Insurance Statement should be included with any new, renewed or varied tenancy agreement.
  • Property managers and landlords must keep records to demonstrate the compliance with all Healthy Homes Standard that apply or will be applied during the tenure of your rental home.

Starting 1 July 2021

  • Property managers and private landlords should make sure their rental properties conform in accordance with Healthy Homes Standards within 90 days of a new, renewed , or altered lease.
  • All boarding households (except Kainga Ora and Community Housing Providers with registered boarding house tenancies) must adhere to the Healthy Homes Standards regardless of the date the tenancy was started.

Beginning 1 July 2023

  • All houses rented from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must comply with the Healthy Homes Standards regardless of the date the tenancy was started.

From July 1st 2024

  • All rental homes are required to comply with Healthy Homes Standards regardless of when the tenancy began.

Heating Lyall Bay

Lyall Bay rental properties must have a fixed source of heating that can warm the main or largest living room to at least 18 degrees Celsius, even on the coldest days of the year. This is the minimum temperature indoors suggested by the World Health Organisation for people’s physical well-being and mental wellbeing.

The source of heat needs to remain fixed (i.e. not portable) that is, at least 1.5 Kilowatts in heating capacity, and it must have the minimum required heating capacity to heat the living space in general.
