Fines for Failing to Comply
Since the 1st July of 2021, when a brand new, renewed or varied tenancy is signed for a Totara Park rental property, all Healthy Homes compliance work need to be finished by the end of 90 days.

If the property manager does not supply the required information within 21 days from being informed of the request, they will receive an infringement notification and could be fined up to $750.
Furthermore, there’s also a penalty up to $900 for property owners or property managers providing a false or inaccurate Healthy Homes Compliance Statement or other information. The person who is responsible for this fine is the one who is named on the tenancy agreement as being the person letting the property out It could also be the landlord’s name or the property management company.
All the information on the Compliance Statement requirements to be correct at the time that the tenancy agreement is executed, and it should be kept updated throughout the duration of the tenancy when any necessary work related to it is finished.
It is also important to remember that a landlord with multiple rental properties may receive even higher fines for non-compliance. The highest penalties are given for severe violations, and landlords who own more than six properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.
